The following agreement is a legal document. Read it carefully and mark each paragraph to denote your acceptance. This release essentially says that you are going on a remote hiking and running adventure - not to a Disneyland ride nor to an air-conditioned shopping mall. If you die, get hurt, or damage your belongings, you are agreeing not make a claim, sue, or expect High Sierra Three Step, its owners, operators, agents, employees, directors and associates , to be legally responsible or pay for any damages. For this reason, personal medical and travel insurance is strongly advised.

 

RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT

I hereby acknowledge that I have voluntarily chosen to go on this three day running and hiking adventure across the Sierra Nevada Mountains with High Sierra Three Step (hereinafter referred to as HS3Step). I know and fully understand that hiking and running is an outdoor activity with inherent risks and potential hazards where serious accidents can occur, participants can die, sustain injuries and property damage. I acknowledge and willingly assume all risks and hazards involved in this running and hiking camp. I have also been advised that I may be exposed to physical injury from a number a natural factors, including but not limited to lack of water, too much water, mountain lions, bears, poisonous snakes, poison oak, ticks, vehicular traffic and other hazards attendant to running or hiking along or across roadways or trails day or night. I understand and accept the risk that I may become injured or incapacitated in a location where it is difficult or impossible for the event management to get required medical aid to me in time to avoid physical injury or even death.

I hereby attest and verify that I am physically fit and have sufficiently trained for this arduous event. I will assume the cost of any search and rescue efforts deemed necessary by event management. I hereby consent to receive medical treatment at my cost which event officials may deem necessary in the event of injury, accident or illness during the footrace and its related activities.

In consideration of the acceptance of my entry in the High Sierra Three Step on August 1 - 3, 2008, for myself, my heirs, executors and administrators, I hereby voluntarily release, discharge and hold-harmless HS3Step, and its owners, officers, agents, Directors, employees, and volunteers for any and all claims of liability arising out of their negligence, recklessness, strict liability, breach of contract, or any other act or omission which causes my illness, injury, death, and damages of any nature in any way connected with my participation in this activity; and expressly waive any benefit I may otherwise have under Section 1542 of the Civil Code of California. I also expressly agree to release and discharge HS3Step, its owners, officers, agents, Directors, employees, and volunteers from any act or omission of negligence in rendering or failing to render any type of emergency or medical services. In signing this document, I fully recognize and understand that if I (or any minor on whose behalf I am executing this release), am hurt, die, or my property is damaged, I am giving up my right to make a claim or file a lawsuit against HS3Step and all other parties and affiliates named herein even if they negligently or by some other act of omission cause the injury or damage.

As a parent or legal guardian of a participant under 18 years of age, I have read and voluntarily agreed that said minor may participate in this running and hiking event, and I execute this release on their behalf. In addition, I give HS3Step, its agents, employees, volunteers and associates permission to treat said minor in case of illness, injury, emergency, or accident. Should emergency medical services become necessary, for the undersigned participant or minor, the expenses are the sole responsibility of the participant and not of HS3Step.

The venue of any dispute that may arise out of this agreement or otherwise between the parties to which HS3Step or its agents is a party shall be the County Supreme Court in Placer County, California.

IMPORTANT CONDITIONS:
  1. An entry fee of $tba (US Dollars) must be paid separately to complete this application. You may make payment online (via PayPal) or by check payable to "Matt Scribner," the Event Co-Director. A dishonored check is subject to a $25 reprocessing fee. Foreign entrants must send a money order, not a personal check. A separate payment must accompany each entry.
  2. All cancellations must be submitted in writing. A $50 per entrant charge will apply. Refunds will be made following the event.
  3. No refunds will be made for cancellations received after (tba), 2009, unless Event Management can refill the space.
  4. By clicking on the Submit button below, you are certifying that the above-entered information is complete and correct to the best of your knowledge.
